Derby man who fled Wegmans charged with possession

Diorio Diorio Joshua Diorio, 30, of Derby, is charged with petit larceny, criminal possession of a controlled substance, resisting arrest and obstructing governmental administration.

On July 30, West Seneca Police responded to a reported shoplifting at Wegmans on Orchard Park Road. Upon arrival, officers said they were directed to a field nearby where Diorio had fled the scene.

Police reportedly located Diorio and engaged in a foot pursuit, which took them into, and across, Cazenovia Creek where Diorio was apprehended after a brief struggle.

Once returned to the patrol car, Diorio vomited a plastic bag allegedly containing suspected heroin, authorities said.

Diorio was transported to Erie County Medical Center for evaluation and is due back in West Seneca Court at a later date.
